Welcome to BTR Direct. By using this website you are agreeing to comply with and be bound by these terms and conditions of use, which together with our privacy policy govern BTR Direct's relationship with you in relation to this website. If you do not agree to these terms then you must cease using the site.

The term "BTR Direct" or "us" or "we" refers to the owner of the website whose registered office is Unit 14, Hove Technology Centre, St Josephs Close, Hove, BN3 7ES. Our company registration number is 5668581. The term "you" refers to the user or viewer of our website.

We reserve the right to make changes to our website, policies and these terms at any time and without notice. You will be subject to the terms in force at the time you use the website or that you order goods from us (unless any change to these are required to be made by law or government authority, in which case it will apply to orders previously placed by you). If you do not wish to accept the new terms then you should not continue to use this website as your continued use will indicate your agreement to be bound to these.

1. Your account:

When you register to use this website, you will be asked to create a password. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You will be responsible for all activities and orders that are submitted on your account. If you know, or suspect that someone else knows your password you should notify us immediately. BTR Direct reserves the right to refuse access to the website, terminate accounts, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

2. Orders:

When you place an order to purchase a product from BTR Direct, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product, this is accepted by us and the order completed when we send email confirmation to you that we've despatched that product to you. You consent to receive communications from us electronically and that such communications satisfy any legal requirement for these to be in writing.

3. Deliveries & Postage:

We will aim to despatch all orders in line with the timeframes detailed on the product information pages, although please be aware these are approximate. Items will be despatched to the address given by you in your order, by either Royal Mail (standard, recorded or special delivery) or a courier service – this is dependent on weight and value. Postage is free on all orders within the UK. For orders in Europe the cost is £2.00 and outside of Europe the cost is £3.00. Please note your goods may be sent to you in instalments.

4. Non-receipt of goods:

On rare occasions, items may be delayed or lost in transit, which is beyond our control. Please allow 14 days from the date of despatch (as confirmed in our despatch email) before contacting us. You will be entitled to either replacement goods or a refund.

5. Returns and refunds:

You may cancel your order with us but this must be done within the ‘cooling-off’ period of seven working days from the day after the goods have been received. If you wish to cancel your order within this cooling-off period then please contact us link to contact form quoting your name, address and order reference number. If you have already received the goods, please return these to BTR Direct; please note the goods must be returned in the condition they were sent to you, if sealed, they must remain sealed. You will be liable for any charges incurred in returning the goods. A refund of the goods will be given by the same method in which payment was made; this will be within 30 days of receipt of your cancellation notice.

6. Faulty goods:

In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, we will offer a replacement of the item or a full refund. Please be aware that you must contact us first to receive instruction for return and this notification must be received within 10 working days of delivery of the goods. BTR Direct will cover the costs of the return in these cases either by freepost address or by sending a courier to collect the item from you. Any items returned directly without prior notification and approval may be rejected. Please be aware that this term does not include any issue with DVD region compatibility which is fully explained on our website.

7. Pricing & availability:

• While we try and ensure that all prices on our website are accurate, errors may occur and if we discover an error in the price of goods that you have ordered from us, we will inform you as soon as possible. You may continue with the order at the correct price or cancel it and receive a full refund.

• Prices stated do include postage (UK only) and include VAT where applicable (currently charged at 15%). Postage costs for non-UK orders will be confirmed at the checkout. If VAT is not applicable to the country where the goods are being sent to, then this element of the price will automatically be deducted during the checkout. VAT invoices are available upon request.

• All orders are subject to availability and if the goods ordered are not available you will be contacted by email and will have the option to wait until the item is available from stock or you can cancel the order and receive a full refund. 

8. Payment:

• Payment can be made by any major credit or debit card, including Visa, MasterCard and American Express. We also accept payment by Paypal and Google Checkout. Payment will be debited and cleared from your account before the despatch of goods. Please be aware that payment will be taken on receipt of the order and not when the goods are despatched, this includes the pre-ordering of titles before they are due for release.

• You confirm that the debit or credit card being used is your own. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses for any reason to authorise payment to us, we will not be liable to you for any delay or non-delivery.

• By offering to purchase goods you are confirming you are 18 years or over.

• We will take reasonable care to keep the details of your order and payment secure. Our secure socket layer software (SSL) is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal details, including card number, name and address and ensures nothing can be read as it travels over the Internet.

9. Customs:

If your delivery address is outside of the UK, you may be subject to import duties and taxes which are levied once the package reaches its destination. Any additional charges for customs clearance must be borne by you and BTR Direct have no control over these. Please note that customs policies vary widely from country to country so you should contact your local customs office for further information. Additionally, we would like you to be aware that when despatching products internationally, cross-border shipments are subject to opening and inspection by customs authorities.

10. Your conduct:

Please be aware that you are responsible for all electronic communication and content sent to us. You may not use this website for the following purposes:

• Fraudulent or illegal activities

• To send any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material

• To breach copyright, trademark, confidence, privacy or any other right

• Any activity that in any way causes, or is likely to cause the website or access to it to be interrupted, damaged or impaired in any way

• To transmit material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice

11. Losses:

BTR Direct will only be liable under these terms for losses which were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. The products sold on the site are for domestic and consumer use only and we will not be responsible for any business loss or any other indirect or consequential loss. We do not exclude or limit liability by law for death or personal injury caused from our negligence, breach of duty, gross negligence or wilful misconduct.

12. Website disclaimer:

• The information contained in this website is for general information purposes only. The information is provided by BTR Direct and whilst we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

• Through this website you are able to link to other websites which are not under the control of BTR Direct. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

• Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products or information available through this website meet your specific requirements.

• Every effort is made to keep the website up and running smoothly. However, BTR Direct takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control. Occasionally, your access to the site may be restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as it reasonably can.

• This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

• All trademarks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website.

• Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
